1. Introduction and Acceptance

Welcome to HolisticTalks ("we," "our," "us," or the "Company"), an educational service operated by Miloš Stojiljković Rolović — Pr Administrativne usluge Mistro Rekovac. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Service"), which provides AI-simulated conversations with historical figures for educational and informational purposes.

By creating an account, using the Service, or clicking "I Agree," you accept and agree to be bound by these Terms. If you do not agree, you may not use the Service.

These Terms form a legally binding agreement between you and HolisticTalks. They apply to all users, including free trial users and paid subscribers.

2. Description of Service

HolisticTalks is an educational platform that uses artificial intelligence to simulate conversations with historical figures based on their publicly available writings, books, and notes.

  • Multiple subscription plans with varying conversation limits
  • Multi-language support

Important: The Service is designed for educational and informational purposes only. It is not a medical, psychological, legal, or professional advisory tool. AI-generated responses may contain inaccuracies, omissions, or biases.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 16 years old (or the age of majority in your jurisdiction) to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3.2 Account Creation

To access the Service, you must:

  • Create an account with a valid email address and password
  • Provide accurate and complete registration information
  • Obtain administrator approval (if required)
  • Accept these Terms and our Privacy Policy

3.3 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we suspect any security breach or violation of these Terms.

4. Subscription Plans and Billing

4.1 Subscription Plans

We offer subscription plans with varying monthly conversation limits and features:

  • Free — $0 — 5 questions per month
  • Student — $9.99 — 100 questions per month
  • Academic — $29.99 — 300 questions per month
  • Master — $39.99 — 500 questions per month

4.2 Billing and Payments

  • Billing Cycle: Subscriptions are billed monthly in advance.
  • Payment Methods: We accept major credit cards and other payment methods provided by our payment processor (Paddle), which acts as merchant of record for all transactions.
  • Taxes: Prices are exclusive of applicable taxes (e.g., VAT), which will be added at checkout by Paddle.
  • Refunds: Refunds are handled according to our Refund Policy. If you cancel your subscription, you will not receive a refund for the current billing period, except as required by applicable law.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the renewal date. You can cancel anytime through your account settings.

4.4 Price Changes

We may change subscription prices with at least 30 days' notice via email or in-app notification. Price changes will take effect at the start of your next billing cycle.

4.5 Free Trial

Free users receive 5 conversations per month. Additional conversations require a paid subscription. We reserve the right to modify or terminate free trials at any time without notice.

5. Acceptable Use Policy

You agree not to misuse the Service. Prohibited activities include:

  • Misuse of Content: Attempting to extract medical, psychological, or legal advice from the Service or treating AI-generated content as professional guidance.
  • Reverse Engineering: Reverse-engineering, decompiling, or attempting to extract the source code or underlying algorithms of the Service.
  • Redistribution: Republishing, reselling, or redistributing AI-generated content for commercial purposes without our explicit consent.
  • Unauthorized Access: Attempting to access accounts, data, or systems you are not authorized to access.
  • Fraudulent Activity: Using the Service for any unlawful, fraudulent, or harmful purpose, including impersonation or harassment.
  • Data Scraping: Using automated systems (bots, crawlers) to extract data from the Service.
  • Overloading: Sending excessive requests or taking actions that may disrupt the Service for other users.

Violation of this policy may result in immediate termination of your account without refund.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its name, logo, branding, interface, software, design, and underlying code, is owned by HolisticTalks or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, educational, non-commercial purposes, subject to these Terms.

6.3 User-Generated Content

You retain ownership of the questions you submit to the Service. However, by submitting questions, you grant us a non-exclusive, royalty-free license to use, store, and process your content for the purpose of providing and improving the Service.

6.4 AI-Generated Content

AI-generated responses are provided for your personal use and may not be reproduced, republished, or used for commercial purposes without our explicit permission.

6.5 Restrictions

You may not:

  • Copy, modify, or create derivative works from the Service or its content
  • Use our trademarks or branding without our written consent
  • Remove or alter any copyright or proprietary notices

7. AI Transparency (EU AI Act Compliance)

In accordance with the EU AI Act (effective August 2, 2026), we provide the following transparency information:

  • AI System: The Service uses an AI system to simulate conversations with historical figures.
  • Interaction Notice: You are interacting with an AI system, not with a human being. This will be clearly communicated before you start your first conversation.
  • Purpose: The AI is designed for educational and informational purposes only. It is not a diagnostic, therapeutic, or decision-making tool.
  • Limitations: AI-generated content may contain inaccuracies, hallucinations, or biases. You should independently verify any information you receive.
  • No Automated Decision-Making: The Service does not make decisions that have legal or significant effects on you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated content will be accurate, complete, or reliable
  • The Service will meet your specific requirements

NO MEDICAL, PSYCHOLOGICAL, LEGAL, OR PROFESSIONAL ADVICE IS PROVIDED THROUGH THE SERVICE. You should always consult qualified professionals for advice concerning your health, legal matters, or other professional issues.

ALL AI-GENERATED CONTENT SHOULD BE VERIFIED AGAINST PRIMARY SOURCES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • Direct Damages: Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us (if any) during the 12 months preceding the claim.
  • Indirect Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.
  • No Liability for AI Content: We are not responsible for the accuracy, completeness, or use of AI-generated content, or for any decisions or actions you take based on such content.

This limitation of liability applies to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless HolisticTalks, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your misuse of AI-generated content

11. Termination

11.1 Termination by You

You may cancel your account and subscription at any time through your account settings. Upon cancellation, you will have access until the end of your current billing period.

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice or liability, if you:

  • Violate these Terms
  • Misuse the Service
  • Attempt to harm the Service or other users

Upon termination, your right to use the Service will immediately cease. Fees paid are non-refundable.

11.3 Effect of Termination

Upon termination:

  • Your account and data may be deleted (subject to data retention policies)
  • You will no longer have access to the Service
  • Provisions that by their nature survive termination (e.g., disclaimers, limitations of liability) shall remain in effect

12. Data and Privacy

Your privacy is important to us. Our collection, use, and processing of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to:

  • The collection and processing of your personal data as described in our Privacy Policy
  • The transfer of your data to third-party service providers (e.g., Base44, Google Gemini API, Lemon Squeezy) for the purpose of providing the Service

13. Third-Party Services

The Service integrates with third-party providers, including:

  • Base44 — Platform provider
  • Google Gemini API — AI model provider
  • Paddle — Payment processor (merchant of record)

We are not responsible for the practices, policies, or content of these third-party services. Your use of third-party services is governed by their respective terms and policies.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet outages, or third-party service failures.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

15.2 Dispute Resolution

If you have any dispute or claim relating to these Terms or the Service:

  • Informal Resolution: We encourage you to contact us first to seek an informal resolution.
  • Governing Jurisdiction: Any legal action shall be brought exclusively in the courts of the Republic of Serbia.

15.3 For EU Users

If you are a resident of the European Union, you may also have the right to bring proceedings in the courts of your country of residence and to lodge complaints with your local data protection authority.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver by us must be in writing.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and HolisticTalks regarding your use of the Service and supersede all prior agreements, understandings, or representations.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the Service.

For material changes:

  • We will provide at least 30 days' notice via email or in-app notification.
  • Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

For non-material changes:

  • We will update the "Last Updated" date at the top of this document.
  • Your continued use of the Service constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
